California Juvenile Laws

If you commit a criminal offense as a minor, penalties can include getting locked up in a juvenile detention facility and/or probation. Both have a negative effect on future employment and your life. Despite the common misconception, juvenile records are not automatically sealed once you turn 18 in the state of California. These records remain accessible until you obtain a judicial order to seal them or have them removed from your personal file.


Juvenile Defense
As a minor you have the right to request parental or legal representation to be present during interrogation. Any statements you make to the police need to be proven they were given freely, voluntarily and understood by the under age individual. If that's not the case, then these statements may be thrown out and not used against you.

Note: criminal investigators can tape minors through hidden cameras and listen to recorded conversations between them and anyone such as your parents. In 1989, the California Court of Appeals stated this is not a privileged communication and is not a violation of the Fourth Amendment right to privacy or the Sixth Amendment right to counsel. This evidence can be used against you as a juvenile. For this reason it's best not to speak to anyone without legal representation.
